Eviction Advice
Once you’re in mortgage arrears and have been unable to agree a way to satisfy your lender, they will take you to court and the judge will order a repossession notice. At this time you will have been given a date by which you must leave your property.
If you don’t vacate your home by that date, your mortgage lender will call in the bailiffs.
But while you’re living in your home, you still have the opportunity to stop the eviction. When the bailiffs give you notice, they will also give you a form that you should complete explaining your circumstances and reasons for stopping or delaying the eviction process. This should be returned as soon as possible to Sell or Yell.
Once you have called our experts and agreed a way forward, we will fill in the form to tell the courts what you are doing to prevent your eviction:
- A sale has been agreed with Sell or Yell and the date on which the sale will go through
You may also be able to delay proceedings if:
- You have young children or disabled children so you will need more time to find alternative accommodation
- You are ill or waiting for an operation, stating your recovery time and if you will be able to repay the debt when you return to work
- Your financial position has improved, along with details of why and how you will be able to repay the debt
Whatever you do, don’t give up. Even being served an eviction notice doesn’t mean you are going to lose your home.
